I am asking again. Last time. I'd have posted directly to the Admins Lowel and Jason, but in the matter of time in which I had to post, I couldn't figure out how to do just that, hence my post in this category. I'm glad you took the first step with your discussion and arrived at other useful names that you could use besides STARSCAPES. Please follow through now. One day, when you have your own trademarks, you'll find that it is in your company's best interests to be diligent in protecting them. This is an almost daily task for us; you're not "just being picked on". I like your site and wish you all the best. JP

JP we've discussed the matter and the answer is - no. We understand your need to defend your trademark, however, if you looked into our site you would discover two things:
1) We are not a profit driven organization, so there is no profit loss that we would be taking from you.
2) Two companies/entities may have the same trademark/name if their core business have nothing to do with one another. Your company makes ceiling murals. We are a Empire Playing Game Sim community.
We are apples and oranges.
If you wish to pursue this venture to a legal matter then that is on you. But you would lose, or actually, your lawyer(s) would from the fees they would charge you.
Good luck in your business venture. We consider this issue to be concluded.

It must be a fairly recent thing, considering I had a Starscapes site on yahoo for years, it might even still be there for all I know, it was an attempt at a roleplay writing project also and never had any complaints during the time. I even still have the graphic title bar I used for mine, heh. Mine was mostly active from 2001 to 2003, and it seems the group is still there also as well as I just checked to see. *snickers* groups.yahoo.com/group/StarScapes/Anyhow, unless his was created prior to Dec of 2000 then I have the more valid claim on copyright/trademark and as such could ask him to change his name instead... Regardless I am entirely fine with extending the use of my prior/existing usage of the name StarScapes as it stands within this format =)

Well, even if we trademark the name, which we won't as it's more like Forgotten Realms or Dragonlance, copyrite, but not tradmarked for anything other then how the design looks, it would be under a different goods and services section which is not illegal or breaking with any codes.
So, I will keep the StarScapes name, but I will strike a medium, I will turn the name into Star-Scapes. With the '-' it is no longer the same as his, but works for all the material we already created for it.

I just find it interesting that when I went to search for starscapes to see what he had, google automatically filled in "starscapes scam" for me, and the first article in the list was referring to JP. The few articles I read all seemed sketchy and I think we should be cautious in taking anything he says at face value.

It was the only reason I thought we should change the name, then I figured that we are a literary group, not a sales group and am not worried about being confused for him. Really he has more to worry about with the 'scam' popping up at the end of his company automatically then us. If anyone where to be looking for his product and see that they'll pull away in a heart beat. This is also why I've been recruiting for our site on RPG forums and listings. Not leaving to chance for anyone to find us.

I think he realized he can't do anything about it. Like the Star Wars and Star Trek boards. Those are trademarked and copywrited names, but they are used, as long as no money is being made. In our case the StarScapes isn't even the same to each other.

I've already read the Empire info for them. Welcome to both! There are similarities between the Drakendi and the Dra'Keshi. Totally unintentional, I assure you! Stellar created his Dragon-Elves way before I created mine. Hopefully, there are enough differences to help everyone keep them separated in their minds. Even the names are very similar. Sheesh!
